Position Description:
Employment Litigation Associate (Wage & Hour)
Our client, a nationally recognized management-side labor and employment law firm, is seeking an experienced Employment Litigation Associate with 5+ years of wage and hour litigation experience to join its Portland office.
This is an exceptional opportunity for an attorney who focuses on defending employers in complex wage and hour matters, including class and collective actions. The successful candidate will work on sophisticated litigation throughout Oregon and the Pacific Northwest while serving as a strategic advisor to employer clients on high-stakes employment disputes.
Responsibilities
  • Defend employers in complex wage and hour litigation in state and federal courts
  • Handle all phases of litigation from case inception through resolution
  • Develop litigation strategy for class, collective, and representative actions
  • Draft and argue:
    • Pleadings
    • Dispositive motions
    • Class certification and decertification motions
    • Other substantive briefing
  • Manage written discovery and complex discovery disputes
  • Take and defend depositions
  • Prepare matters for mediation, arbitration, trial, and settlement negotiations
  • Analyze and advise clients regarding wage and hour compliance issues, including:
    • Employee classifications and exemptions
    • Overtime and regular rate calculations
    • Meal and rest break compliance
    • Payroll practices
    • Wage statement requirements
    • Final pay obligations
  • Collaborate with attorneys and clients to provide practical, business-oriented solutions
Qualifications
  • J.D. from an ABA-accredited law school
  • Active membership in good standing with the Oregon State Bar
  • 5+ years of employment litigation experience
  • Significant experience handling:
    • Wage and hour litigation
    • Class and collective actions
    • State and federal employment claims
  • Strong litigation skills, including:
    • Motion practice
    • Discovery management
    • Depositions
    • Litigation strategy development
  • Exceptional legal research, analytical, and writing abilities
  • Strong organizational and project management skills
  • Ability to manage multiple sophisticated matters simultaneously
  • Strong client-service orientation and communication skills
Preferred Experience
Experience advising and litigating matters involving:
  • State wage and hour laws
  • Fair Labor Standards Act (FLSA) claims
  • Wage classification disputes
  • Overtime compliance issues
  • Payroll and compensation practices
  • Class and collective action defense
