S&C Obtains Dismissal of Shareholder Suit Against Volkswagen in Ruling Strengthening Defenses for Non-U.S. Companies Facing New York Shareholder Derivative Litigation
In a decision on April 6, a New York state court ruled in favor of Volkswagen AG, making it more challenging for shareholders to bring legal action against foreign corporations in New York. This decision expands on a similar victory that S&C secured on UBS’s behalf in 2021, which stopped investors from suing the Swiss business in New York. The plaintiffs attempted to get around two recent rulings from the New York Court of Appeals, but the S&C team stopped them, and the court rejected their attempt.
